Information on the terms of entering into a motor vehicle insurance contract

Insurer information

The company is a member of the Generali group, listed in the Insurance Company Group List administered by ISVAP (hereinafter "insurer").

Characteristic of the motor vehicle insurance contract

The rights and obligations under the insurance contract are governed by:

  • the pertinent provisions of the Civil Code, Section 8, - subdivision 15, as amended,
  • the Act No. 381/2001 Corpus Juris about obligatory motor third party liability insurance, as amended (hereinafter "the MTPL Act"), provided the subject of the contract is motor vehicle third party liability (hereinafter "MTPL insurance"),
  • the pertinent general insurance conditions that form an inseparable part of the insurance contract,
  • the pertinent special insurance conditions that form an inseparable part of the insurance contract,
  • other provisions of the insurance contract.

Extent of coverage

  • a) MTPL insurance covers anyone liable for damages incurred in relation to operation of the motor vehicle listed in the insurance contract. The extent of insurance is as specified by points 2., 3. of the Article II. of the MTPL General Insurance Terms 08.
  • b) Motor-hull insurance is negotiated based on the Motor-hull General Insurance Terms 08, Article IV. for the event of damage or destruction of the motor vehicle due to any accidental incident that is not expressly excluded in the Motor-hull General Insurance Terms 08 or in the insurance contract, mainly due to traffic accidents, natural disasters, vandalism, cases of theft or unauthorized use of the vehicle or its parts, unless specifically stated otherwise in the insurance contract. It is also possible to purchase supplementary policies with the insurance contract, as specified by the Motor-hull General Insurance Terms 08.

Assistance services

Assistance services are intended solely for single-track and multi-track vehicles of up to 3.5 t. Assistance services in the extent of MTPL ŠTANDARD, MTPL PLUS, KASKO STANDARD are provided by the insurer free of charge throughout the term of insurance. The assistance services provided are governed by special pertinent insurance terms. Limits of the assistance services provided are available at www.generali.sk.

Indemnity

Indemnity payout is governed by the relevant general insurance terms. Indemnity limits per single MTPL claim are specified by the MTPL Act and can be further increased based on agreement recorded in the insurance contract.

Exceptions from the insurance 

Exceptions from the insurance are listed in the pertinent articles of the general insurance terms under the name:

  • exceptions from liability insurance or exceptions from insurance.

Excess

  • a) MTPL insurance is purchased without obligation to pay excess, unless the insurance contract says otherwise.
  • b) Motor-hull insurance is purchased with obligation to pay excess, as specified by the Motor-hull General Insurance Terms 08, Article XII, unless the insurance contract says otherwise.

Insurance termination

Termination of insurance is governed by the valid legislation and the general insurance terms.

  • a) Should MTPL insurance terminate during the term of insurance due to failure to pay premiums, the person obliged by the law to enter into the insurance contract is bound to purchase an insurance contract for the remainder of the term of insurance from the same insurer. An insurance contract between such person an a different insurer for such term of insurance is null and void.
  • b) Motor-hull insurance may terminate due to failure to pay premiums. The insurer is entitled to premium payments for the period until the insurance termination. Should there be an insured event which eliminates the reason for further insurance, the insurer is entitled to premium payments for the rest of the term of insurance during which the insured event took place.

Premium, term of insurance

As specified by the general insurance terms, the insurer has the right to, based on changes to conditions that have direct influence on the amount of premium, change the premium for the next term of insurance. The insurer is bound to inform the policyholder of such decision in advance.

The system of insurer protection from financial institution failure is secured with the tracking mechanism created in accordance with the Insurance Act No. 8/2008 Corpus Juris , as amended. When performing insurance related activities, the insurer is bound to comply with the Insurance Act No. 8/2008 and is subject to supervision by the National Bank of Slovakia.
